TERMS AND CONDITIONS
Maxikids is the trade mark and property of the company Zivax Maxi SRL, a legal entity operating in the Republic of Moldova. The use of the site www.maxikids.md (hereinafter Maxikids), is regulated by the Terms and Conditions of Use presented below. Accessing the website www.maxikids.md, confirms the implicit and unconditional acceptance of the respective terms.
DEFINITIONS AND TERMS
Seller - Maxikids.
Buyer - can be any natural person over the age of 16, who makes an Account on the Site and places an Order.
User - any natural person over the age of 16 who, by completing the account creation process, has agreed to the site-specific clauses in the General Terms and Conditions section.
Account - the section of the Site consisting of an e-mail address and a password that allows the Buyer to send the Order and which contains information about the Buyer and the Buyer's history on the Site. The Buyer is responsible and will ensure that all information entered when creating the Account is correct, complete and up to date.
Favorites - section of the Account that allows the Buyer to create Lists of Goods that he wants to follow in order to make a possible purchase.
List - the section in Favorites in which the Buyer can add Goods that he wants to follow in view of a possible purchase and which he can later delete or add to the shopping cart ("My Cart").
My Cart - section of the Account that allows the Buyer to add Goods that he wants to purchase at the time of addition or at a later time.
Website - the online store hosted at the web address: maxikids.md.
Order - an electronic document that intervenes as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, his intention to purchase Goods from the Site.
Goods - any product posted on the Site, including the products mentioned in the Order, to be provided by the Seller, to the Buyer as a result of the concluded Contract.
Discounts - the act of displaying for commercial purposes a finite number of Goods with a limited and predefined stock, for a limited period of time set by the Seller.
Contract - represents a contract between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
Content - represents:
- all information on the Site that can be visited, viewed or otherwise accessed using electronic equipment;
- the content of any e-mail sent to Buyers by the Seller by electronic means and / or any other available means of communication;
- any information communicated by any means by an employee / collaborator of the Seller, the Buyer, according to the contact information, specified or not by him;
- information related to the Goods and tariffs charged by the Seller during a certain period;
- data regarding the Seller, or other privileged data of the Seller.
Transaction - the collection or refund of an amount resulting from the sale of a Good by Maxikids, to the Buyer, by using the services of the card processor agreed by the Seller, regardless of the method of delivery.
Document - these Terms and Conditions.
INTELECTUAL PROPERTY
2.1. All materials published on the site, including logo, still images, dynamic images, text and multimedia content, web graphics are protected by copyright, being the exclusive property of Zivax Maxi SRL.
2.2. Copying, distribution, publication, transfer to third parties, modification, use of any Content in any context other than the original intended by Maxikids is not permitted.
ONLINE SALES POLICY
3.1. The online product purchase service is allowed to any Buyer who has reached the age of 16.
3.2. Communication with the Seller can be done through direct interaction with him or through the data mentioned in the "We are in Contact" section of the Site - Online Sales, or through chat.
3.3. All tariffs related to the Goods presented on the Site are expressed in lei (MDL, EUR, USD) and include VAT.
3.4. In the case of online payments the Seller is not / cannot be held responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of his issuance differs from MDL. The responsibility for this action lies solely with the Buyer.
3.5. The products are made available to you exactly as they are presented and are offered within the available stock. We do not guarantee the availability in stock at any time of all products presented on the site. When validating the order, we will inform you exactly if one product or another is available in stock or not. The images with products are presented on the site as a presentation, and the description of the products is identical to the pictures presented. We reserve the right to remove, modify or add new parameters without prior notice.
4.1. The Buyer can place Orders on the Site, by adding the desired Goods to the shopping cart, and will complete the Order by making the payment in one of the ways indicated in the Payment Options section. Once added to the shopping cart, a Good is available for purchase as long as there is stock available for it. The addition of a Good to the shopping cart, in the absence of the completion of the Order, does not entail the registration of an order, implicitly also the automatic reservation of the Good. Items in your shopping cart are not reserved and can be purchased by other customers.
4.2. After placing the order on the site, your order will be processed by our operator and ready for shipment. During the processing of the order, our operator will check the availability of the product of your choice, if the money arrived in the store account (under the conditions of payment by method 1 or 2 specified in the Payment Options chapter and will contact you to specify the order details (by e-mail or telephone) Our operator will also specify the approximate date when the product ordered by you will be delivered.
4.3. The Seller may cancel the Order placed by the Buyer, following a prior notification addressed to the Buyer, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other in the following cases:
4.3.1. non-acceptance by the issuing bank of the Buyer's card, of the transaction, in case of online payment;
4.3.2. invalidation of the transaction by the card processor approved by Maxikids, in case of online payment;
4.3.3. the data provided by the Buyer on the Site are incomplete or incorrect;
4.4. If the product ordered by the Buyer is no longer in stock, the Seller will inform the Buyer of this fact and will return to the Buyer's account the value of the Good, within a maximum of 7 (seven) days from the date on which the Seller took aware of this fact or from the date on which the Buyer has expressly expressed its intention to terminate the Contract.
4.5. If, when placing the order, you are not sure about the size to choose, you can consult the Size Chart, and when you are called by our operator to consult with him and change it verbally. 4.6. If orders are placed on public holidays (Saturdays and Sundays, as well as public holidays), they will be processed on the next working day. Orders placed on working days until 13:00 will be processed on the same day. Orders placed on working days after 13:00 will be processed on the next working day.
4.7. If the size of the product you choose does not match, then you can change the product in any Maxikids store by providing the invoice receipt.
PAYMENT OPTIONS
5.1. Payment for products ordered in our online store can be made in the following ways:
- Cash, upon receipt of the ordered product. You will receive a check with the amount of the product purchased.
- With online bank card. Payment for ordered products is made through the PayNet payment system when placing the order on the site.
5.2. The prices of the products are expressed in MDL, EUR, USD and include VAT.
SHIPPING
6.1. The delivery conditions of the Goods sold by Maxikids can be found in the Shipping section.
6.2. The Seller will ensure the proper packaging of the Goods and will ensure the transmission of the accompanying documents.
6.3. The Seller will deliver the Goods only on the territory of the Republic of Moldova, Europe, USA, Canada.
6.4. The products are not delivered in Transnistria and in the village of Varnița.
RETURN OF PRODUCTS
7.1. The conditions for returning the Goods sold by Maxikids can be found in the Return section.
7.2. According to the legislation of the Republic of Moldova, each user can benefit from his full right to return or change the products purchased in our stores, within 14 days, if there are no signs of wear or color change of the product texture, is clean and has not been washed.
7.3. In order to enter into force, the return document (form) must be completed no later than the 14th calendar day following the day of receipt of the product. This form must be full completed, and we will respond to you by email or phone within 3 business days with return instructions.
7.4. In case of Change / Replacement, it is allowed to choose a similar or more expensive product, with the payment of the price difference.
7.5. Underwear products CANNOT BE RETURNED.
PROCESSING OF PERSONAL DATA
8.1. As the owner of the maxikids.md Site, Zivax Maxi SRL is committed to maintaining the confidentiality of the information provided by Buyers. Please read the Privacy Policy regarding the processing of personal data, which is part of this Document.

DISPUTES AND FINAL PROVISIONS
10.1. The conditions of use of this Document, as well as any disputes that may arise from the agreement or through the use of the website maxikids.md, will be resolved amicably or through the legislation of the Republic of Moldova as well as the International.
10.2. Any disputes between the Seller and the Buyers will be settled amicably or, if this is not possible, the disputes will be resolved by the courts of the Republic of Moldova.
10.3. Continued use of this site implies implicit and unconditional acceptance of those terms.
